Arbitration Counsel
Arbitration is a private alternative to traditional courthouse litigation. Commercial arbitration typically involves businesses waiving their right to litigate by instead contractually agreeing (in the event of a future dispute) to engage a private judge-for-hire. This private judge is known as the arbitrator, and the case they oversee between the disagreeing parties is the arbitration.
Arbitration is a by-product of the litigation system, so a skilled arbitration counsel will have experience in both arenas. Not all litigators, however, have arbitration experience. Even fewer have substantial ADR training and meaningful business acumen.
Linda Maria Wayner began her career as a litigation and arbitration associate at Skadden Arps Slate Meagher & Flom LLP in New York City. She then served as General Counsel for International Affairs for the Mayor’s Office of New York City under the leadership of Mayor Michael R. Bloomberg. Linda has taught international commercial arbitration for over fifteen years at the Elisabeth Haub School of Law at Pace University. She has appeared as arbitration counsel before the AAA, the ICC, and JAMS, and has worked on international commercial litigation in various federal jurisdictions, including the United States Supreme Court.
